Ohio v. EPA

Firm: Hogan Lovells

Issue Area: Environment, Climate, & Fossil Fuels

Case summary

Hogan Lovells represented Kinder Morgan, one of the country's largest natural gas pipeline companies, in a successful effort to get the Supreme Court to block the EPA's "Good Neighbor" rule. The rule required power plants and industrial facilities in 23 states to cut emissions of nitrogen oxides (smog) that drifts across state lines into downwind states. EPA adopted the rule to protect people in those downwind states, where ozone exposure is linked to asthma attacks and premature death.
